GENERAL TERMS AND CONDITIONS OF SALE
This document sets out the terms and conditions governing the use of this website and the purchase of the items offered on it. Please read these conditions carefully before using the website. By using the website or placing an order through it, the User accepts these Terms and Conditions and the Privacy Policy. If the User does not agree with them, they are requested not to place any orders.
These conditions may be subject to change. It is the User’s responsibility to review them periodically, as the conditions in force at the time of accessing the website shall apply.

2. User details and use of the website
The information or personal data provided by the User shall be processed in accordance with the Privacy Policy. By using the website, the User authorizes the processing of such information and personal data and declares that all information and/or personal data provided to Sharra Pagano are accurate and truthful.
3. Use of the website
By using this website and/or placing orders through it, the User agrees to use the website only to make legally valid inquiries or orders. The User agrees not to place false or fraudulent orders. If Sharra Pagano has reasonable grounds to believe that such an order has been placed, it shall be entitled to cancel the order and inform the competent authorities. The User undertakes to provide a truthful and accurate email address, postal address and/or other contact details and consents to Sharra Pagano using this information to contact them where necessary, as stated in the Privacy Policy. If the User does not provide all the required information, Sharra Pagano will not be able to process the order.
By placing an order through this website, the User (Customer) declares that they are at least 18 years old and have the legal capacity to enter into binding contracts.
4. Service availability
The items offered through this website are available in Italy.
5. Contract formation
The information and details contained on this website do not constitute an offer for sale, but an invitation to negotiate. No contract shall exist in relation to any products until the Customer’s order has been accepted.
The Customer may select one or more products to purchase and add them to a virtual shopping cart, which may be reviewed at any time before submitting the order.
By clicking the “Purchase” button, the Customer will start the order submission process. By clicking the “Place Order” button at the end of the online purchase procedure, the Customer submits the order to Sharra Pagano. Each order submitted in this way shall constitute a contractual proposal by the Customer.
Upon submission of the order, Sharra Pagano will promptly send an email confirming receipt of the order to the email address provided by the Customer. With this email, Sharra Pagano will also inform the Customer whether the order has been accepted or not. Sharra Pagano reserves the right to accept or reject orders at its sole discretion, without the Customer being entitled to make any claims in the event of non-acceptance.
The order shall be deemed accepted and the contract concluded when the Customer receives the email confirming acceptance of the order.
In any case, the order will not be shipped until the funds have been received by Sharra Pagano. Sharra Pagano is not obliged to supply any additional products included in an order until shipment has been confirmed in a separate shipping confirmation email.
6. Product availability
All product orders are subject to availability.
7. Refusal to process an order
Sharra Pagano reserves the right to remove any product from this website at any time and/or to remove or modify any material or content on the website. While every effort will be made to process all orders, exceptional circumstances may arise that require Sharra Pagano to refuse to process an order after having sent the order confirmation. Sharra Pagano reserves the right to do so at any time, at its sole discretion.
Sharra Pagano shall not be liable to the Customer or to any third party for removing any product from the website, whether or not the product has been sold, for removing or modifying any material or content on the website, or for refusing to process an order after having sent the order confirmation.
8. Delivery
Without prejudice to the provisions of Article 7 and except in extraordinary circumstances, Sharra Pagano undertakes to ship the product or products indicated in the shipping confirmation or, if no delivery date is specified, within 10 days from the date of the shipping confirmation.
Delays may occur due to product customization, specialized items, unforeseen circumstances, or the delivery area.
If, for any reason, Sharra Pagano is unable to meet the delivery deadline, the Customer will be promptly informed and may cancel the order and receive a full refund of the amount paid.
Deliveries are not made on Saturdays or Sundays. An order shall be considered delivered once a signature has been obtained upon receipt at the agreed shipping address.
9. Failure to deliver
If delivery cannot be completed, a notice will be provided indicating where the package is located and how to collect it. If the Customer is not present at the agreed delivery time, they must contact Sharra Pagano to arrange a new delivery date.
The Customer will have 4 days to collect the package from storage. After this period, if the package has not been collected, Sharra Pagano will consider this as a withdrawal from the contract, which shall be deemed terminated.
Following termination of the contract, the amount paid for the products will be refunded as soon as possible and, in any case, within 14 days from the date on which the contract is deemed terminated.
10. Transfer of risk and ownership
The risk relating to the products shall pass to the Customer upon delivery. Ownership of the products shall pass to the Customer only once Sharra Pagano has received full payment of all amounts due, including shipping costs, or upon delivery if this occurs at a later time.
11. Price and payment
The price of the products shall be the one indicated on the website, except in cases of obvious error. Although Sharra Pagano endeavours to ensure that all prices on the website are correct, errors may occur. If an error is found in the price of the ordered products, the Customer will be informed as soon as possible and will have the option to reconfirm the order at the correct price or cancel it. If no agreement can be reached, the order will be cancelled and the full amount paid will be refunded.
Sharra Pagano is not obliged to supply the product or products at the incorrectly stated lower price, even after the shipping confirmation has been sent, if the pricing error is obvious and could reasonably have been recognized by the Customer.
Website prices include VAT but exclude shipping costs, which will be added to the total amount payable.
Prices may change at any time; however, changes will not affect orders for which a shipping confirmation has already been sent.
After selecting the items to purchase, they will be added to the shopping cart and the next step will be order completion and payment.
The Customer may pay by Visa, Mastercard, American Express, prepaid cards, or PayPal. To reduce the risk of unauthorized access, card details are encrypted. Upon receipt of the order, a pre-authorization will be carried out on the Customer’s card to ensure sufficient funds are available. The card will be charged when the order is dispatched. By clicking “Pay by Credit Card”, the Customer confirms that the card belongs to them. Credit cards are subject to checks and authorization by the issuing institution. If authorization is not granted, Sharra Pagano will not be responsible for delays or non-delivery and no contract shall be concluded.
12. VAT
In accordance with applicable regulations, all purchases made through the website are subject to Value Added Tax. Prices displayed on the website include VAT.
13. Invoicing
Pursuant to Article 22, paragraph 1, no. 1 of Presidential Decree no. 633/1972, the issuance of an invoice is not mandatory unless requested by the Customer at or before the time of the transaction. If the Customer wishes to receive an invoice, they must select the “invoice” option during checkout and provide their tax code and/or VAT number and billing address. The invoice will be sent by email once the order has been completed and shipped.
14. Returns and exchanges policy
General provisions
If the Customer is not satisfied with their order, they may exercise the right of withdrawal within 14 days from the day they received the product or products purchased on the Sharra Pagano website. The right of withdrawal does not apply to contracts for the supply of customized products. The right of withdrawal applies exclusively to products returned in the same condition as received.
Returns via courier
The Customer must contact Sharra Pagano within 14 calendar days from delivery of the order by sending an email to sharrapaganosales@sharrapagano.it or by calling +39 02 29519867 to request a return. Sharra Pagano will promptly send, by email, a return form to be completed and a return code associated with the purchased product.
Once the form has been completed, the Customer must send it to sharrapaganosales@sharrapagano.it. After verifying the received document, Sharra Pagano will contact the Customer to arrange collection of the product to be returned. The product, complete with packaging and tag, must be placed by the Customer inside the pre-labelled security envelope included in the original package.
Returns in showroom
The Customer may return the product within 14 calendar days from delivery of the order directly to the showroom at Piazza Castello 19, Milan. The Customer must present the purchased item, complete with packaging and tag, placed inside the security envelope received at delivery, together with the completed return form.
Neither option involves additional costs. If the Customer chooses not to use the free return options available, any return costs will be borne by the Customer.
The Customer may choose whether to receive a refund of the amount paid or to exchange the item for one or more products of equal or higher value.
Refunds will be made as soon as possible and no later than 14 days from the date on which the intention to exercise the right of withdrawal was communicated, and only after Sharra Pagano has carefully assessed the condition of the item. The Customer will be informed if they are entitled to a refund. The refund will be issued using the same payment method used for the purchase.
If the Customer wishes to make an exchange, after completing the return procedure and after Sharra Pagano has assessed the condition of the item and informed the Customer, they may select a new product of equal or higher value than the returned item.
Returns of defective products
If the Customer believes that the product is not in conformity with the contract at the time of delivery, they must immediately contact Sharra Pagano, providing the product details and describing the defect. Sharra Pagano will then indicate the procedure to follow.
After examining the returned product, the Customer will be informed by email whether a refund or replacement will be issued, as applicable. The refund or replacement will be carried out as soon as possible and, in any case, within 14 days from the date the Customer receives the email. The amount paid for such products will be fully refunded, including delivery costs, using the same payment method used for the purchase.
15. Intellectual property
The User acknowledges and agrees that any copyrights, trademarks, or other intellectual property rights in the materials or content presented as part of the website are the property of Sharra Pagano or its licensors. The User may use such material only as expressly authorized. This shall not prevent the User from using the website to the extent necessary to copy order information or contact details.
16. Viruses, hacking and other cyber risks
The User must not misuse the website or introduce viruses, trojans, worms, logic bombs or other programs or material that may cause technological damage. Unauthorized access to the website, its server, or any related servers, computers or databases is prohibited, as is any denial-of-service attack. Breach of this clause may constitute a criminal offence. Sharra Pagano will report any such breach to the relevant authorities and will cooperate to identify those responsible.
Sharra Pagano shall not be liable for any damage or loss caused by a denial-of-service attack, viruses or other technologically harmful material that may affect the User’s computer or electronic equipment as a result of using the website or downloading material from it.
17. Links from our website
Where the website contains links to other websites or materials of third parties, such links are provided for information purposes only. Sharra Pagano has no control over the contents of those websites or materials and accepts no responsibility for any damage or loss arising from their use.
18. Written communications
Applicable regulations require that some information or communications be in writing. By using the website, the User agrees that most communications with Sharra Pagano will be in electronic form.
19. Assignment of rights and obligations
The contract between the User and Sharra Pagano is binding on both parties and on their respective successors and assigns. The Customer may not assign, transfer or otherwise dispose of the contract or any rights or obligations arising from it without prior written consent. Sharra Pagano may assign or transfer the contract at any time without affecting the Customer’s statutory rights.
20. Events beyond our control
Sharra Pagano shall not be liable for any failure or delay in performance of its obligations caused by events beyond its reasonable control. During such events, Sharra Pagano’s obligations shall be suspended. Sharra Pagano will use all reasonable means to resolve the situation and resume performance of its obligations.
21. Waiver
If Sharra Pagano fails to enforce strict performance of any obligation or to exercise any right, this shall not constitute a waiver of such rights or obligations.
22. Severability
If any provision of these terms is declared invalid or unenforceable by a competent authority, the remaining provisions shall remain in full force and effect.
23. Right to amend the terms
Sharra Pagano reserves the right to review and amend these terms at any time. The User shall be subject to the terms in force at the time of placing each order, unless changes are required by law or by governmental authorities, in which case they may apply retroactively.
